Heian Walk Privacy Policy

NOBU CORPORATION, K.K. (“we,” “us,” or “our”) provides the app “Heian Walk” and its related services (the “Service”). This Privacy Policy explains how we handle your personal information when you use the Service.

1. What Is Personal Information

“Personal information” means information about a living individual that can identify a specific person, such as a name, date of birth, gender, address, or other description. It also includes information that cannot identify a specific person by itself but can do so when combined with other information.

2. Information We Collect

When you use the Service, we collect the following personal information through the app:

  • Step count data: Your step count information stored and recorded by the app and your device.
  • Information you send us: Information such as your name, email address, and the content of your inquiry that you provide by email, web form, or other means. We use this only to respond to your inquiry. There is no place in the app to enter this information.

Health data. To count your steps with your smartphone, the app needs to connect to an external service: Apple Health on iOS devices, or Health Connect on Android devices. The app connects to these services and obtains your step count only with your explicit consent.

  • Information obtained through Apple Health is used in accordance with “Health app & privacy” (https://www.apple.com/legal/privacy/data/en/health-app/) and Apple’s Privacy Policy (https://www.apple.com/legal/privacy/).
  • In version 1.0.14 and earlier of the Android version, the app connects to Google Fit. Information obtained through Google Fit is used in accordance with the Google Fit Developer and User Data Policy (https://developers.google.com/fit/policy), including the Limited Use requirements (https://developers.google.com/fit/policy#limited_uses_of_user_data).
  • Information collected through Health Connect is used in accordance with Health Connect’s permissions policy, including Google’s Limited Use requirements.

We use your step count to award in-game items and to show your step history in the app. We do not use information obtained from Apple Health or Health Connect for advertising, marketing, profiling, or any other commercial purpose, and we do not share it with third parties without your consent.

Data security. For data transfer, data from the app is sent to and from Amazon Simple Storage Service servers. The data is encrypted during transmission and stored using the security features of Amazon Simple Storage Service. Stored data is automatically deleted after 8 days.

Age assurance under U.S. law. For users of the U.S. App Store or Google Play, we confirm your age range and the status of parental consent through Apple’s or Google’s features, in accordance with U.S. state laws. We do not collect your date of birth. If a parent or guardian withdraws consent, we store the purchase identifier issued by Apple or the installation identifier issued by Google on our servers in order to restrict access to the app. We do not use this information for any purpose other than age assurance required by law.

3. How We Use Your Information

We collect personal information only by fair means and use it for the following purposes:

  • To provide and operate our services
  • To respond to your inquiries (including verifying your identity)
  • To send you necessary communications, such as maintenance and important notices
  • To detect and investigate tampering, fraud, and illegal activity related to the Service
  • For other purposes to which you have explicitly consented when we collected your personal information
  • For purposes incidental to the purposes above

4. Changes to How We Use Your Information

We will change the purposes for which we use personal information only when the new purpose is reasonably related to the original purpose. If we change a purpose, we will announce the new purpose on this website.

5. Sharing with Third Parties

We do not provide personal information to third parties without your prior consent, except in the following cases or as otherwise permitted by the Act on the Protection of Personal Information or other applicable laws:

  • When it is necessary to protect a person’s life, body, or property, and it is difficult to obtain your consent
  • When it is especially necessary to improve public health or promote the healthy development of children, and it is difficult to obtain your consent
  • When we need to cooperate with a national government agency, a local government, or a party entrusted by either of them in carrying out duties prescribed by law, and obtaining your consent would interfere with those duties

A recipient is not considered a third party when personal information is provided as part of a business succession due to a merger or other reasons.

6. Your Right to Access

If you ask us to disclose your personal information, we will disclose it to you. However, we may decline to disclose all or part of it if disclosure would:

  • Risk harming the life, body, property, or other rights or interests of you or a third party
  • Seriously interfere with the proper conduct of our business
  • Otherwise violate any law or regulation

If we decide not to disclose, we will let you know. In principle, we do not disclose information other than personal information, such as history information and characteristic information.

7. Correction and Deletion

If your personal information that we hold is incorrect, you may ask us to correct, add to, or delete it (“correction”) through the procedures we set. If we determine that we need to respond to your request, we will make the correction. We will let you know when we have made the correction or have decided not to.

8. Stopping the Use of Your Information

If you ask us to stop using or to delete your personal information (“stop using”) because it is being handled beyond the purposes of use or was obtained by improper means, we will investigate as necessary. If, based on the results, we determine that we need to respond to your request, we will stop using it. We will let you know when we have stopped using it or have decided not to. If stopping the use would be very costly or otherwise difficult, and we can take other measures to protect your rights and interests, we will take those measures instead.

9. Cookies and Access Logs

  • To make the Service more convenient, we may store and use cookies, access logs, and similar data, and may use technologies such as cookies and JavaScript to obtain records of your activity. We do not treat this information as personal information because it cannot identify a specific person by itself. However, if it can identify a specific person when combined with other information, we treat it as personal information.
  • We use Google Analytics, provided by Google, on our website to research and analyze how it is used. Google Analytics uses cookies and similar technologies to understand how you use the website. If you do not want your data to be used by Google Analytics, please use the Google Analytics Opt-out Browser Add-on provided by Google (https://tools.google.com/dlpage/gaoptout).
  • We do not respond to Do Not Track (DNT) signals.

10. Advertising

We do not use advertisements delivered by third parties in the app or on our website.

11. Disclaimer

THE SERVICE IS PROVIDED “AS IS.” WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SERVICE MAY CONTAIN LINKS TO THIRD-PARTY COMPANIES OR ORGANIZATIONS, AND WE DO NOT GUARANTEE SUCH THIRD PARTIES OR THEIR PRODUCTS OR SERVICES.

We are not responsible in any way for the collection of personal information by third parties in the following cases:

  • When you disclose your own personal information to a third party using a feature of the Service or by other means
  • When a person becomes identifiable from information you have entered in the Service

12. How Long We Keep Your Information

We keep personal information for as long as necessary for the purposes for which it was collected, for such period as is permitted, or for such period as is consistent with applicable law.

13. Children’s Privacy

The Service is not primarily directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13, except to the extent necessary for age assurance required by law as described in Section 2.

14. Changes to This Privacy Policy

We may revise this Privacy Policy at any time and for any reason. When we do, we will update the “Last updated” date on this page. Unless we specify otherwise, the revised Privacy Policy takes effect when it is posted on this website or when the app is updated.
